Terms of Use

Please read these Terms of Use (“Terms”, “Agreement”) carefully before using the Night Rider mobile application (“App”, “Service”) operated by Non-Binary Studio (“we”, “us”, or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Night Rider, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Apple Standard End User License Agreement (EULA)

If you are using Night Rider on an Apple device, you acknowledge and agree that your use of the App is also governed by the Apple Media Services Terms and Conditions, including the Apple Standard End User License Agreement (EULA).

In summary:

  • The App is licensed, not sold, to you.
  • You may use the App only on Apple-branded products that you own or control.
  • You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
  • You may not transfer, redistribute, or sublicense the App.
  • You may not copy, reverse-engineer, decompile, disassemble, attempt to derive the source code, modify, or create derivative works of the App.

3. User Content

You are responsible for any content you submit to the App, including requests and audio. You agree not to use the App to submit or generate content that is unlawful, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.

4. Intellectual Property

All content, features, and functionality of the App (including but not limited to text, graphics, logos, and software) are the exclusive property of Non-Binary Studio or its licensors.

5. Subscriptions and Payments

Some features of the App may require a paid subscription, managed via RevenueCat and the App Store or Google Play. All payments, renewals, and cancellations are handled by the respective app store. Please refer to their terms for more information.

6. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

7. Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, Non-Binary Studio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the App.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
